1. Ownership of Generated Content

1.1 Your Rights to Outputs

Subject to your compliance with these terms and payment of applicable subscription fees, productshootz hereby assigns to you all rights, title, and interest in and to the images you generate using our Service ("Outputs"). This assignment includes the right to:

• Reproduce, distribute, display, and create derivative works
• Use Outputs for commercial purposes (paid plans only)
• Sublicense rights to third parties
• Register copyrights in Outputs (subject to applicable law)

1.2 Copyright Eligibility

Important Legal Notice: Copyright law regarding AI-generated content varies by jurisdiction and is evolving. In some jurisdictions, purely AI-generated content may not be eligible for copyright protection. However, Outputs that incorporate substantial human creative input (such as detailed prompts, significant editing, or combination with other creative elements) may qualify for copyright protection.

We recommend consulting with legal counsel in your jurisdiction regarding the copyright status of specific Outputs, particularly for high-value commercial uses.

3. Restrictions on Use

Regardless of your subscription plan, you may NOT use Outputs for:

• Any purpose prohibited by our Terms of Service or AI Usage Policy
• Creating content that defames, harasses, or violates the rights of others
• Registering trademarks on Outputs that are substantially similar to outputs available to other users
• Claiming that Outputs are photographs or human-created when disclosure is legally required or materially relevant
• Training competing AI models without explicit written permission
• Any use that misrepresents the nature or origin of the content in a manner likely to deceive

5. Training Data Policy

5.1 Outputs (Generated Images)

No Training on Outputs: productshootz does NOT use your generated images (Outputs) to train, improve, or refine our AI models. Your creative results remain your private property and are not used to benefit our algorithms or other users.

5.2 Input Content (Uploaded Images)

By default, images you upload for model fine-tuning or reference ("Input Content") may be used to improve our core AI models. You may opt out of future training use at any time by adjusting your privacy settings in your account dashboard.

6. Your Input Content

You retain all ownership rights to images and content you upload to the Service ("Input Content"). By uploading Input Content, you grant productshootz a license to:

• Process and store the content to provide the Service
• Use Input Content for AI training (unless you have opted out)
• Create derivative works as necessary for the Service

You represent and warrant that you have all necessary rights to upload and use Input Content with our Service, and that such use does not infringe on the rights of any third party.

7. DMCA and Copyright Complaints

We respect the intellectual property rights of others. If you believe that content available through our Service infringes your copyright, please submit a notice to our designated Copyright Agent:

Your notice must include:

• Identification of the copyrighted work claimed to have been infringed
• Identification of the material claimed to be infringing and its location
• Your contact information (name, address, telephone, email)
• A statement that you have a good faith belief that the use is not authorized
• A statement, under penalty of perjury, that your notice is accurate
• Your physical or electronic signature

8. productshootz's Intellectual Property

The productshootz platform, including our website, software, AI models, documentation, and branding (but excluding your Outputs) remain the exclusive property of productshootz AI. These materials are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or reverse engineer any part of our platform without prior written permission.
